1. Introduction and Acceptance
Welcome to GMG Medical Group PA (“GMG Medical Group PA,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, telehealth platform, mobile applications, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
2. Definitions
“You” / “User” / “Patient”: Any individual accessing or using our Services.
“Provider”: A licensed healthcare professional who offers telehealth consultations through our platform.
“Partner Pharmacy”: A third-party pharmacy that dispenses medications if prescribed.
3. Services Provided
GMG Medical Group PA facilitates telehealth consultations between Users and Providers. We do not practice medicine, nor are we a pharmacy. Our role is limited to connecting you with Providers, who may prescribe medication if they deem it medically appropriate.
4. Not for Emergencies
Our Services are not intended for emergency or urgent medical situations. If you experience a medical emergency, call 911 or go to the nearest emergency room immediately.
5. No Guarantee of Prescription
Any prescription is provided solely at the discretion of a licensed Provider. GMG Medical Group PA makes no guarantee that you will receive a prescription.
6. No Guarantee of Results
Individual responses to treatment vary. Testimonials or success stories on our platform do not guarantee similar outcomes. Always consult with your Provider regarding the potential benefits and risks of any treatment.
7. Third-Party Pharmacies and Providers
Partner Pharmacy: If you receive a prescription, it is dispensed by a third-party pharmacy. GMG Medical Group PA does not handle or ship medications and is not responsible for any errors in dispensing.
Provider Independence:Providers using our platform are independent professionals responsible for their own medical judgment, advice, and treatment decisions. GMG Medical Group PA does not oversee or control a Provider's practice of medicine.
8. User Responsibilities
- Accurate Information: You agree to provide truthful, current, and complete information when creating an account or completing medical forms.
- Age and Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services.
- Compliance with Laws: You agree to comply with all applicable laws, including those related to the use of telehealth services in your state or region.
9. Intellectual Property
All content on the Services—such as text, graphics, logos, and software—is the property of GMG Medical Group PA or its licensors. You may not copy, reproduce, or distribute any portion of our Services without our prior written consent.
10. Disclaimers
No Warranties:The Services are provided on an “as is” and “as available” basis. GMG Medical Group PA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Telehealth Limitations: Telehealth services may be subject to technology failures, delays, or interruptions. We do not guarantee that the Services will be uninterrupted or error-free.
Compounded Medications (If applicable): If your Provider prescribes compounded GLP-1 medications, note that they are not FDA-approved. They are sourced from a licensed compounding pharmacy, and we disclaim any liability related to their use.
11. Limitation of Liability
To the fullest extent permitted by law, GMG Medical Group PA and its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. This includes any damages resulting from medical treatment decisions made by Providers, medication dispensing by Partner Pharmacies, or technology interruptions.
12. Indemnification
You agree to indemnify and hold GMG Medical Group PA harmless from any claims, damages, or expenses (including attorney's fees) arising out of or related to your violation of these Terms, misuse of the Services, or infringement of any rights of a third party.
13. Termination
We may suspend or terminate your access to the Services at any time, for any reason, including if we believe you have violated these Terms. You may also discontinue use of the Services at any time.
14. Modifications to the Terms
We reserve the right to modify these Terms at any time. We will update the “Last Updated” date to reflect the effective date of changes. By continuing to use the Services after any changes become effective, you agree to the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.
17. SMS/Text Messaging Program
Program Name: GMG Medical Group PA Patient Communications
Program Description: GMG Medical Group PA sends SMS messages to patients for healthcare-related communications including appointment reminders, order and shipping notifications, prescription updates, medication refill reminders, and customer support. All recipients are existing patients who have signed up for our services.
Message Frequency: Message frequency varies based on your treatment activity. You may receive up to 10 messages per month depending on appointments, orders, and refill cycles.
Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your messaging plan.
Opt-Out: You can opt out at any time by texting STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and no further SMS messages will be sent.
